How We Deal With Sales Tax Issues:

  1. Identify the Problem
  • Underpayment or Overpayment: First, we figure out whether the issue is that you underpaid or overpaid sales tax. Overpayments may be refundable, while underpayments could lead to penalties and interest.
  • Incorrect Rate: Sales tax rates differ by location (state, county, city), so we make sure you’re charging the right rate.
  • Exemption Issues: We ensure you’re properly handling sales tax exemptions for eligible customers or items.
  • Filing Errors: If there were errors in your filings (wrong amounts, missed filings), that will need to be corrected.
  1. Understand the Specific Sales Tax Laws
  • Sales tax laws vary by state and sometimes by locality, so we make sure you’re familiar with the specific regulations in your jurisdiction.
  • Nexus: We determine if you have a “nexus” (a significant presence) in the state or locality, as this will dictate whether you’re required to collect sales tax.
  • Marketplace Facilitators: If you sell through online platforms (like Amazon or eBay), those platforms might collect sales tax on your behalf, but you still need to ensure proper reporting.
  1. Fix Errors
  • Amended Returns: If we realize that you made an error on a sales tax return, we file an amended return with the state or local tax authority.
  • Refund Requests: If you overpaid, we could request a refund for the overpaid amount. This usually involves submitting a refund claim with supporting documentation.
  1. Penalties and Interest
  • Late Filing/Payment Penalties: Some states impose penalties for late filings or payments, but many offer options for penalty abatement or reduction if you have a good reason.
  • Interest: If you owe back taxes, interest will accrue on the unpaid amount. Some states allow you to work out a payment plan to reduce the financial strain.
  1. Tax Amnesty Programs

Some states offer sales tax amnesty programs that allow you to pay back taxes without penalties or reduced penalties.

The process to qualify for a tax debt settlement is dependent on your personal financial situation. To find out if you qualify, schedule a complimentary consultation with one of our tax consultants, and be prepared to answer questions regarding your monthly income and expenses, additional assets to your name, and your total tax liability.

The Fresh Start program, also known as the Offer in Compromise, allows a taxpayer to settle their tax debt for a portion of the full amount owed when proven that the taxpayer is experiencing a financial hardship. If accepted, the Offer eliminates all outstanding balances with the IRS and releases any potential liens placed against the taxpayer.

While both are collection tools used by the IRS, a tax lien and a tax levy are not interchangeable terms. A lien is a claim to a taxpayer’s property due to a tax debt, while a levy is the actual action of seizing a taxpayer’s property.

Without protection in place, the IRS is legally allowed to seize your property or wages due to an unpaid tax liability.
